In light of the imminent introduction of the Community Infrastructure Levy (CIL), and reforms to planning obligations brought about by the final CIL Regulations 2010, CLG has now published a New Policy Document for Planning Obligations for a consultation period ending on 17 June. The new policy document in its final form will replace Circular 5/05: Planning Obligations, and form an annex to CLG's new Development Management Planning Policy Statement.
CLG has also published an overview of the CIL, and guidance on charge setting and charging schedule procedures. Last of all in this series is the ‘the Incidence, Value and Delivery of Planning Obligations in England in 2007-08: Final Report’, a research report which looks at planning obligations agreed in England in 2007-08 and examines the delivery of planning obligations agreed in previous years.
NLP Director Jonathan Wallace concluded, "The opportunity to respond to the consultation on s106 policy is helpful and provides developers with the opportunity to ensure that they are not charged twice for infrastructure associated with their schemes, and that s106 payments sought relate only to mitigation or compensation for development impact. The development industry and local authorities alike will also appreciate having the additional guidance on CIL in advance of 6 April when the new planning charge comes into effect."
